1. General Information / Scope of Application

1.1. The following General Terms and Conditions („GTC“) and the House Rules apply to the purchase of tickets to the attraction selected by the customer and operated by Salzburger Burgen & Schlösser Betriebsführung („SBSB“) as well as to all resulting relationships between SBSB and the user („customer“) and are expressly accepted by the customer by clicking on the „I have read and accepted the GTC“ declaration in the online ticket shop. These documents can be printed out, saved or downloaded as a pdf file.

1.2. The SBSB also sells tickets for the funicular railway to Hohensalzburg Fortress. The SBSB does not operate the funicular railway itself, the SBSB only sells tickets. If the customer also purchases a ticket for the funicular railway, the customer thereby enters into a contract of carriage with Salzburg AG based on the „ Conditions of carriage for the funicular railway to Hohensalzburg Fortress „.

1.3. These GTC, the conditions of carriage for the funicular railway to Hohensalzburg Fortress and the house rules are expressly accepted by the customer by clicking on the declaration „I have read and accepted the GTC“ in the online ticket shop. These documents can be printed out, saved or downloaded as a pdf file.

2. Order / Conclusion of Contract

2.1. A valid registration and a valid e-mail address are required to purchase tickets online. Tickets can only be ordered if all man- datory fields (fields marked with an asterisk) are completed. Before sending the order, the customer receives an overview of the content of his entire order including prices, which can be corrected or confirmed under point 1 of the order form.

2.2. By sending an order to SBSB by clicking on the button „order with costs“, the customer submits a binding offer. The acceptance of this offer by SBSB follows the positive verification of the payment transaction by sending the tickets to the specified e-mail address. Upon receipt of the order by SBSB and the subsequent order confirmation by SBSB, the contract for the purchase of the ticket(s) is concluded between SBSB and the customer.

2.3. The tickets are only valid for the dates or periods selected by the customer during the ordering process.

2.4. The services offered by SBSB are leisure services that are to be provided at a specific time or within a precisely specified period (§ 18 Abs. 1 Z 10 FAGG). Therefore, the customer is not entitled to the statutory right of cancellation for distance selling transactions in the case of online ticket sales and other distance selling contracts (e.g. by telephone or email). The conclusion of this contract was not preceded by a meeting and the transaction is subject to the Distance and Off-Premises Transactions Act (except for Section 3); Section 3 KSchG (Rücktrittsrecht) therefore does not apply either.

3. Prices / Payment

3.1. The prices published in the online ticket shop apply. All prices are in euros and include the statutory value added tax.

3.2. The respective total invoice amount is made up of: the ticket price (less any reductions/discounts), and the respective statutory (Austrian) value added tax.

3.3. Payment is made according to the payment method selected by the customer during the order process. Payment processing is carried out by Adyen N.V.

3.4. The purchase process is completed when you enter the desired payment method and click on the „Order with costs“ button. The purchase is then binding and can no longer be cancelled. Each ticket is only valid once payment has been made in full.

3.5. If price reductions or discounted tickets (e.g. school, student, apprentice tickets) are used, the legitimisation for the respective reduction must take place before or upon entry. If a discount is not correctly selected, the ticket must be rebooked at the ticket office (with a surcharge to the normal price). If a ticket has been purchased with an admission time restriction and ad- mission takes place before or after the selected period, the surcharge for the currently available ticket must be paid.

4. Information on the Booking Process according to § 9 E-Commerce Law (ECG)

4.1. The following technical steps lead to the customer submitting an effective and binding offer and to the conclusion of a contract:

     4.1.1. Selection of the desired type and number of tickets by the customer at [www.salzburg-burgen.at];

     4.1.2. Login/registration of the customer by entering their data;

     4.1.3. Selection of the payment method desired by the customer;

     4.1.4. Possibility to check the order in the overview before placing a chargeable order;

     4.1.5. Confirmation by clicking on the corresponding button that the customer has read and accepted the GTCs and;

     4.1.6. By clicking on the „Order with costs“ button, the booking process is completed and the customer submits a binding offer.

     4.1.7. After receipt of the order, the customer will receive the ticket from SBSB together with confirmation of the concluded contract after positive verification of the payment transaction. This concludes the contract between the customer and SBSB.

5. Provision of tickets

5.1. The tickets will be sent to the customer by separate email to the email address provided during the order process after the contract has been concluded and the payment transaction has been verified. The customer has the option of printing out the ticket independently or presenting it in saved form on the day of the visit.

5.2. Reproduction of a ticket - in any form whatsoever - for the purpose of granting access to unauthorised third parties is prohibited. The principle of first entry applies. The code on the respective ticket is cancelled on first entry. Any further tickets with a code that has already been cancelled do not entitle the holder to access.

5.3. The commercial resale of tickets is not permitted.

6. Warranty and liability

6.1. Claims for damages by the customer, for whatever legal reason, are excluded unless SBSB or a person for whom SBSB is responsible has caused this damage wilfully or through gross negligence. However, personal injury is expressly excluded from this.

6.2. The statutory warranty claims, in particular for consumers, exist and remain unaffected.

7. House rules

7.1. The property is a historical site. It is forbidden to climb on walls, parapets or railings. It is also forbidden to leave the public paths. Parents are liable for their children.

7.2. There is a general driving ban for the entire site. No vehicles may be parked in the castle. Exceptions may only be granted by the castle administration.

7.3. The facility will be cordoned off in the evening. It can only be entered during the posted opening hours and with valid admis-
sion tickets. Unauthorised entry to the facility constitutes trespassing.

7.4. Any other presence in the castle grounds outside the opening hours (work, all events, etc.) must be reported to the castle ad-
ministration in good time and his authorisation obtained.

7.5. The transferee shall bear full responsibility for keys to the central locking system accepted against signature. These keys may not be passed on to third parties under any circumstances and must be returned to the issuer immediately after the end of the activity in the castle. If a key is lost, the affected part of the locking system will be replaced at the borrower‘s expense.

7.6. Any damage to castle property must be reported to the castle administration. Any theft or vandalism will be reported to the police.

7.7. Special attention must be paid to the increased risk of fire on the grounds! The burning of fires and the handling of open flames is prohibited by the fire police throughout the castle grounds. The carrying and use of fireworks, Bengal fires and incendiary devices is prohibited. Smoking is generally prohibited in all indoor areas. Smoking is permitted in the outdoor area; the ash- trays provided for this purpose must be used.

7.8. Taking off or flying over the property with drones is expressly prohibited.

7.9. Any recording and reproduction of photos in the area that goes beyond private use is prohibited. For commercial photography or filming, please contact the castle administration. In addition, Photographs and/or videos, from which it may be possible for you to be identified, may be taken on this property and used on the website of Salzburger Burgen & Schlösser, in social media channels, in print media for public relations, and to present the activities of Salzburger Burgen & Schlösser. These recordings may also be offered in the image database of Salzburger Burgen & Schlösser for an unlimited period of time. If you do not consent to this, we would ask you to please inform the photographer.

7.10. The area and parts of the interior are under video surveillance. The recordings are used exclusively for the preventive protection of persons and objects.

7.11. No refund of the entrance fee will be granted if parts of the facility are not accessible due to events, construction work, safety reasons or other reasons.

7.12. Animals are not permitted in the exhibition rooms. Dogs must wear a muzzle and be kept on a lead in lifts. Exhibits and wall panelling may not be touched, damaged or impaired in any other way. The premises must be kept clean. Eating and drinking is not permitted in the showrooms (sealable containers such as water bottles may be taken in). In the event of damage or soiling, the repair or cleaning costs must be paid. Deliberate damage or soiling will also be reported to the police. Out of consideration for other visitors, we ask you not to use the telephone in the showrooms and to refrain from speaking loudly.

7.13. Our castles are in an exposed location, which is why appropriate footwear must be worn. You may only walk on cleared and/or gritted paths. During this time, please pay particular attention to the impact of ice and snow on footpaths.

7.14. Do not throw any objects from the observation towers and viewpoints. Falling objects can endanger lives. Dispose of your rubbish in the bins provided.

7.15. Areas that have been cordoned off may not be entered.

7.16. The buildings managed by Salzburger Burgen und Schlösser Betriebsführung are historic, listed buildings that do not comply with current building standards in some areas. Such deviations from today‘s building standards can occur, for example, in stair railings, steps, handrails and floor coverings as well as in the height of passages, balustrades, windows and wallpaper. During your visit, therefore, always pay attention to the local conditions and any warning notices. Salzburger Burgen und Schlösser Betriebsführung cannot be held liable for any deviations from current building standards.

7.17. In the event of an audible alarm, contact the supervisory staff. Remain calm and follow the instructions of the supervisory staff. The use of lifts is prohibited in such a case. Emergency exits are only to be used in emergencies and exits, staircases, passageways and escape routes must be kept clear at all times for safety reasons. In the event of a medical emergency, please contact the supervisory staff.

7.18. The instructions of the castle administration and the supervisory staff must be followed. Failure to do so may result in a ban from the premises and/or a police report.

8. Return or replacement of tickets

8.1. A refund of the ticket price due to missing the day of the visit or due to circumstances for which neither party is responsible (e.g. bad weather, traffic jams) is excluded. The opening times of the sights are published at www.salzburger-burgen.at.

9. Data protection

9.1. The customer expressly agrees that the data provided electronically by him in the context of the order may be processed and used automatically by SBSB for the purposes of contract processing, customer service and marketing (including the sending of emails and text messages). Consent to the sending of emails can be revoked at any time. The customer is also entitled to revoke his consent to the use of personal data at any time in writing by email or post to SBSB. Furthermore, we may refer to SBSB data protection guidelines.

10. Applicable law / arbitration

10.1. Austrian law shall apply to the exclusion of the UN Convention on Contracts for the International Sale of Goods and the conflict of laws rules of private international law.

1. The conditions of transport are an integral part of the transportation contract. They apply to the transportation of people and goods alike as well as to the conduct in the railway area.

2. The fulfilment of the transportation contract and thus the effectiveness of the subject-matter conditions of transport commences upon entering and completes upon leaving the parts of the facilities dedicated to the operation of the funicular.

3. By purchasing the ticket, the passenger acknowledges the conditions stated below and he is obligated to comply with it.

4. A violation of the conditions of transport may also result in liability claims.

5. The funicular company is required to carry out the transportation in accordance with the schedule, provided

5.a. that currently valid legal regulations and conditions of transport as well as the instructions of the funicular company, which serve public safety and order, are being complied with, and

5.b. that the transportation is not prevented by circumstances which the funicular company cannot avert and which it cannot remedy.


6. Intoxicated persons and those, who do not comply with the provisions of these conditions of transport and any instructions issued beyond these provisions by the funicular company in order to maintain public safety and order, or who are obviously incapable of doing so due to their particular physical or mental condition, are excluded from transportation.

7. Transportation is served by regular rides according to a particular schedule and additional rides as needed. Additional special rides are subject to the discretion of the funicular company.

8. Passengers must be in possession of a valid ticket. As a rule, these are not transferable, though exceptions are determined in the fare schedule. The period of validity of the ticket is printed on these or determined by the fare schedule.

9. The ticket must be presented upon demand to the staff members of the funicular company. If a ticket is in such condition that the validity can no longer be determined, then a new ticket must be purchased.

10. A passenger, who is found not to be in possession of a valid ticket after the commencement of the ride, must pay not only the amount payable for such a ticket for this ride, but also an additional surcharge as determined in the fare schedule, regardless of possible criminal prosecution. The commencement of the ride is defined as the entering and exiting of the control zone or the railway facilities.

11. If the abusive use of a ticket is attempted or carried out, then apart from possible criminal prosecution, the ticket will be seized without reimbursement and an additional surcharge as determined in the fare schedule will become payable.

12. If a passenger refuses the immediate payment of the ticket or the additional surcharge, then the staff members of the funicular company are authorized to demand the presentation of identification and to exclude him from the ride.

13. Tickets, which have been lost, will not be replaced.

14. If the transportation is not carried out for reasons, which are the responsibility of the funicular company, or for reasons listed in item 5 b), then the fare for a single ticket is refunded in its entirety, or otherwise partially, un less the validity of the ticket also ex- tends to other facilities of the funicular company or other facilities, which are part of the fare association. The extent of the refund is determined by the fare schedule.

15. If the transportation is not carried out for reasons, which are the responsibility of the passenger, then there is no right to a refund of the fare price.

16. The following applies to the behaviour of the passengers before, during, and after the transportation:

16.a. Passengers must generally behave in a manner, which does not endanger the operation of the funicular and the passengers, or disturb public order and the operation in general.

16.b. Passengers may only enter areas, which are intended for public access or parts of the facilities and rooms within the stati- ons, which are open to passengers. Entering and exiting is only permissible at the intended locations. These are the upper and lower stations. The middle station is subject to the provisions according to item 23.

16.c. After the station doors open, passengers must enter the funicular cabin as quickly as possible. The area around the doors must subsequently be kept clear.

16.d. The doors of the cabin are closed automatically. Preventing or obstructing the opening or closing of the doors is prohibited. Persons who require assistance with entering or exiting must explicitly inform the station staff. The “EMERGENCY OPE- NING” of the cabin doors through the emergency release mechanism by passengers is only permitted in case of serious emergencies (e.g. in case of fire) when the funicular is not moving.

16.e. Smoking is prohibited in the stations and during the ride.

16.f. If the ride of the funicular stops unexpectedly, then passengers should remain calm and wait for instruc tions by the staff members of the funicular company. Holding or throwing items out during the ride is prohibited.

16.g. After the ride terminates, the platform shall be vacated expeditiously into the indicated direction.

16.h. Any prohibitions, commands, and notices, which are relevant for passengers of the funicular and which are explained through pictograms, must be strictly observed


17. Passengers may take carry items with a total weight of up to 10 kg, which can easily be carried and are not bulky.

18. Persons, who have damaged or soiled the facilities, vehicles or other property of the funicular company, are responsible to pay for the repair or the clean-up. Deliberate or intentional damaging will also be subject to prosecution.

19. Animals may be admitted for transportation, if it can be expected that their transportation does not affect the safe operation, if the owner can safely control the animal during transport and if no other passengers on the same ride object to its transportation.

20. Goods or luggage will only be accepted upon prior special agreement. Luggage will not be accepted for storage.

21. Transportation of goods: Goods will only be accepted for transportation by agreement. The transportation of goods may be refused if the condition of the facilities or the operation do not permit it, or if the transportation could endanger the secure existence and operation of the funicular. The following items are excluded from transportation:

         21.a. Goods, which require special equipment for loading;

         21.b. Goods, whose transportation is likely to cause soiling or damages to the cabin according to the assessment by the funicular
         company;

         21.c. Items which are not suitable for transportation due their dimensions, their weight or their characteristics;
        
         21.d. Goods, whose transportation is prohibited according to current legal provisions;

         21.e. Goods, which according to the [Austrian] Federal Law regarding the road transportation of dangerous goods
                  [German    acronym:    GGST], Federal Law Publ. 1979/209 in its current version, are deemed to be dangerous goods,
                  may be transpor- ted, provided that their weight  and space requirements permit it.

22. The loading and unloading of goods have to be arranged by the sender or the recipient, if the instructions of the operational ma- nagement and its staff members are observed and complied with

23. Entering and exiting at the middle station: Entering at the middle station is only possible for certain types of people. The selection of these people is the responsibility of Salzburg AG. Exiting at the middle station is possible for all passengers, if they comply with the conditions of transport. However, there is no obligation that the transportation to the middle station will be carried out during the next possible ride.

The decision as to whether there will be a stop at the middle station is made solely by Salzburg AG Tourismus GmbH. The wish to exit at the middle station must be disclosed clearly and in a timely manner (upon buying the ticket) to the staff members of the funicular company.
